Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the myflashcards website and application (the "Service"), operated by Neville Z Bharucha ("we," "us," or "our"), a private individual based in Germany. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Section 01
Use of the Service
- The Service is intended for personal educational use only.
- Users must be at least 16 years of age to register for an account. This is the minimum age of digital consent under German law (DSGVO / GDPR Art. 8). Users under 16 require verifiable parental or guardian consent before creating an account.
- Users between 16 and 18 years of age may use the Service; parental supervision is recommended.
- Users must not use the Service for unlawful purposes or in violation of any applicable laws.
Section 02
User Accounts
- Authentication and identity management is handled by Clerk. Clerk manages login credentials such as passwords, while we may access limited account information including your email address for account administration and support. We also store a pseudonymous user identifier provided by Clerk solely to associate your flashcard data with your account. Under GDPR, both this identifier and accessible account information may be considered personal data because they can be linked to a natural person.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- We reserve the right to suspend or delete accounts for abusive or illegal behaviour.
- You may delete your account at any time from the Account settings page. Upon deletion, all your flashcard data will be permanently erased from our database.
Section 03
User Content
- All flashcards and related study data you create on the Service are private and stored in our database. They are not visible to other users or third parties.
- You retain full ownership of the content you create.
- You grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display your content solely as necessary to provide and operate the Service. This licence ends when you delete your content or your account.
- Users may not upload content that is illegal, offensive, or violates third-party intellectual property rights.
- Third-party processing. When you use the AI import feature, word content is transmitted to Google's Gemini API. When you use the audio pronunciation feature, individual word texts are transmitted to Google's Cloud Text-to-Speech API. Both transmissions are server-side. By using these features you acknowledge that the relevant content will be processed by Google in accordance with Google's terms of service. We recommend you do not store personal or sensitive data in your flashcards.
Section 04
Payments and Donations
- The Service is currently free to use. In the future, we may introduce optional paid features. Users will be clearly notified before any previously free features become paid.
- Optional donations via Buy Me a Coffee are entirely voluntary and non-refundable.
- All payment processing is handled entirely by the relevant payment provider (Buy Me a Coffee). We do not store, access, or process any payment information.
Section 05
Intellectual Property
- We claim ownership of the myflashcards name, branding, design, and software code.
- All intellectual property on the Service, unless explicitly provided by users, is our property.
- You may not copy, reproduce, or distribute our intellectual property without our prior written permission.
Section 06
Disclaimers
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that flashcards will improve learning outcomes or exam performance.
- We are not liable for loss of flashcard data, data corruption, or service downtime. Users are responsible for backing up their content using the built-in backup feature if desired.
- Audio pronunciations are generated by Google Cloud Text-to-Speech and are provided as-is. We make no warranty as to their accuracy, naturalness, or suitability for any particular learning purpose.
Note for users in Germany and the EU: The above disclaimers apply only to the fullest extent permitted by applicable law. Nothing in these Terms limits or excludes our liability for damages caused by wilful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, or for any other liability that cannot be excluded under mandatory German or EU law (including §§ 305–310 BGB).
Section 07
Service Availability
- We may modify, suspend, or discontinue the Service at any time, with or without notice.
- We are not liable for any interruptions, downtime, or changes to the Service.
- Where reasonably practicable, we will provide advance notice of significant planned disruptions.
Section 08
Limitation of Liability
- To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- This includes loss of data, loss of profits, or any reliance placed on the Service.
Note for users in Germany and the EU: This limitation of liability applies only to the extent permitted by mandatory applicable law. It does not apply to damages arising from wilful misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit), to injury to life, body, or health, or to any liability that cannot be limited or excluded under §§ 305–310 BGB or other mandatory German or EU consumer protection law.

Dispute Resolution
- We prefer to resolve any disputes informally. Please contact us at [email protected] before pursuing formal action.
- These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions.
- The courts of Hamburg, Germany shall have non-exclusive jurisdiction over any disputes arising from or in connection with these Terms. This does not affect any statutory rights you may have to bring proceedings in your local jurisdiction under applicable EU consumer protection law.
Section 10
Changes to Terms
- We may update these Terms from time to time. The updated Terms will be indicated by a new "Last updated" date at the top of this page.
- For minor changes, continued use of the Service after the updated Terms are posted constitutes acceptance.
- For material changes — particularly those affecting data processing, pricing, or user rights — we will notify registered users by email at least 14 days before the changes take effect. If you do not accept the new Terms, you may delete your account before they come into force.
Section 11
Account Termination
- You may delete your account at any time via the Account settings page within the app. Deletion is immediate and permanent — all associated flashcard data will be erased from our database.
- We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the breach.
- Upon termination by either party, your right to use the Service ceases immediately. We recommend downloading a backup of your data before deleting your account.
